Information on Parenting Time Modifications in Colorado:
In Colorado, the statutes allow the courts to make orders as to Parenting Time. Our attorneys will work hard for you, fighting for a Parenting Plan which is both workable for both parents and allows you to have the appropriate amount of time with your child(ren). It can sometimes be difficult and expensive to modify the plan later, however, there is nearly no situation when an order dealing with children cannot somehow be changed at some point.
Modification of Your Parenting Plan:
If your Parenting Plan is not working out, the attorneys of our law firm wants to help. In Colorado, the parenting plan can be changed for several reasons, amongst them are:
- The parties agree to the modification.
- The child has been integrated into the family of one parent with the consent of the other parent.
- The party with whom the child resides the majority of the time is relocating (moving a substantial distance from the other party, for example, out of state).
- The present arrangement is a threat to the child’s physical or emotional well-being.
Modifications of parenting time are covered by Colorado Revised Statutes § 14-10-129, click HERE to read selected Colorado Statutes.
The lawyers of our law firm understand the intricacies behind the laws dealing with modification of parenting time, or, what is generally referred to as “custody.” If you are in Colorado and you are facing one of the above situations, or otherwise feel that you should have the Parenting Plan modified, contact us. You can talk to a lawyer about your particular situation and we will discuss what can be done.
One important thing to understand is that support and parenting time are treated separately: “…the court shall separate the issues of child support and parenting time and shall not condition child support upon parenting time” (§ 14-10-129.5(2)(a)). (Click HERE for selected family law statutes.) Child support and parenting time are treated separately, a parent generally may not deny parenting time based on lack of child support alone.
If there are generally no problems in regards to working out an arrangement as to parenting time, the Court will likely allow you to submit a parenting plan that you and the other parent have agreed upon. Our Colorado attorneys can help you to reach such an agreement by working with the other party or his or her lawyer. If disputes arise, or other parties, such as the County Department of Human Services, become involved, this becomes more difficult.
In Colorado, there are many ways to resolve disputes as to parenting time. In general, both parents want to spend time with the children and both parents are acting in the best interests of the children. Ideally, or law firm can help you reach a mutually amicable plan that the court will approve. If the other party is not cooperative, our family law attorneys have the ability to put your best case forward, representing your interests in parenting your child(ren) and to press for the result you are looking for.
